Welcome to the TransUnion site ("Site") a web site operated by Trans Union of Canada, Inc. ("TransUnion"). The Site provides data and other information on consumer credit reports ("Content") and other services such as consumer disclosures, online fraud services and online consumer dispute services ("Services").

The Site, the Content and the Services are provided to you subject to your agreement to be bound by these terms and conditions of use ("Terms of Use"). BY ACCESSING OR USING THE SITE OR THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH ONE OR MORE OF THESE TERMS AND CONDITIONS, DO NOT ACCESS OR USE THE SITE OR THE SERVICES.

Use of the Site

TransUnion grants you a limited, non-exclusive, personal, non-transferable license to access and use this Site for personal, non-commercial purposes. TransUnion reserves all right, title and interest not expressly granted under these Terms of Use to the fullest extent permitted under applicable laws.

Except as expressly provided in these Terms of Use, any reproduction, copy, retransmission, distribution, sale, republication, modification, translation of or creation of derivative works based on the Site, the Content and/or the Services, in whole or in part, is strictly prohibited. You acquire absolutely no rights or licenses to the Site, the Content or the Services other than the limited right to use the Site, the Content and the Services in accordance with these Terms of Use.

In connection with the Site, you must not without TransUnion’s prior written consent: (i) reverse engineer, decompile or disassemble any portion of the Site, except where such restriction is expressly prohibited by applicable law; (ii) remove any copyright, trademark or other proprietary rights notice from the Site; (iii) frame the Site, the Content or the Services or any part thereof on any commercial or non-commercial internet website; (iv) systematically download and store the Site, the Content or the Services; or (v) use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine” or otherwise gather the Site, the Content or the Services, or reproduce or circumvent the navigational structure or presentation of the Site.

TransUnion may terminate or suspend your use of the Site, the Content or the Services immediately at any time and without prior notice, for any or no reason, including if it believes that you have violated or acted inconsistently with the provisions of these Terms of Use.

Specific terms and conditions may apply to specific Content and Services available through the Site and such specific terms are in addition to these Terms of Use and may, to the extent expressly specified therein, supersede these Terms of Use.

New Services and Modifications and Updates

Whenever new products or services are introduced on the Site as part of the Services, your use of such Services will be subject to these Terms of Use unless TransUnion notifies you otherwise. TransUnion reserves the right, in its sole discretion, to modify or update these Terms of Use at any time and from time to time. TransUnion will notify you of any changes to these Terms of Use by notice on this Site. Your continued use of this Site after following notice of such change means that you agree to and accept these Terms of Use as amended. If you do not agree to any modifications of these Terms of Use, you must immediately stop using this Site.

Privacy

By accessing and using this Site, including the Content or Services, you are consenting to the collection, use and disclosure of your personal information in accordance with the TransUnion Canada Privacy Policy.

Disclaimer of Warranties and Liability

User Information

Subject to the Privacy Policy, should you provide electronically or through your access to or usage of the Site or the Services, any information or materials including feedback data, such as questions, comments, suggestions or the like regarding any information contained on the Site, such information and/or materials provided by you shall be deemed to be non-confidential and TransUnion shall have no obligation of any kind with respect to such information and/or materials and shall be free to reproduce, use, disclose and distribute such information and/or materials to others without limitation. You hereby grant to TransUnion a transferable world-wide perpetual, irrevocable, royalty-free, non-exclusive license, including the right to sublicense to others, to use, reproduce, distribute, publish, modify, edit, translate, transmit, adapt and display any information and/or materials provided by you (in whole or in part) and/or incorporate such information and/or materials in any form, media or technology now known or developed in the future.

International Use

Because you can access this Site internationally, you agree to follow all local rules about the Internet, data, e-mail, and privacy. Specifically, you agree to follow all laws that apply to transmitting technical data exported from the United States, Canada or the country of your residence.

Applicable Law

The materials in this Site are designed for use by residents of Canada. TransUnion controls and operates this Site through its corporate headquarters within the Province of Ontario. To the extent permitted by applicable law, these Terms of Use shall be governed, interpreted, and enforced according to the laws of the Province of Ontario, Canada, regardless of conflict of laws rules, and the federal laws of Canada applicable therein. To the extent permitted by law, you agree to the non-exclusive jurisdiction of the courts in Ontario, Canada for any disputes, claim or cause of action arising out of, or relating to or in connection with these Terms of Use or your use of the Site, the Content or the Services.

Indemnification

To the extent permitted by applicable law, you agree that your use of the Site, the Content or the Services shall not be made the basis for any claim, suit, demand or cause of action or other proceeding against TransUnion and/or its licensors. You agree, at your own expense, to indemnify and hold TransUnion and its directors, officers, employees, representatives, agents and licensors harmless against any claim, suit, demand, action or other proceeding brought against TransUnion, its directors, officers, employees, representatives, agents and licensors by a third party as a result of your breach of these Terms of Use.

Severability

If any provision of this Agreement is held by a court of competent jurisdiction in any jurisdiction to be illegal, invalid or unenforceable, such provision shall be deemed to be severable and the remaining provisions shall remain in force and effect.

No Waiver

No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any waiver by TransUnion may only be granted in writing and signed by an authorized representative of TransUnion.

Language

Electronic Communications

By accessing this Site or sending electronic mail to TransUnion you are communicating with TransUnion electronically. By doing so, you agree to receive communications from TransUnion electronically. TransUnion will communicate with you by electronic mail at the electronic mail address provided by you or by posting notices on this Site or any other website that that may be generally designated in advance for such purpose.

Technical Specifications

This Site only supports the following internet browsers: Chrome (latest version), IE Explorer 11, Firefox (latest version) and Safari. TransUnion uses cookies to time your session. Cookies are small files which are stored on a user's computer. They are designed to hold a modest amount of data specific to a particular client and website, and can be accessed either by the web server or the client computer.
